Re: Fire Agreement

 

Quarm:  Whitford, Bell, Delp, Craun, McManus of village council members makes this an official meeting of the village council.

Village Council President Whitford speaks to township board and all attendees. Whitford wants to make sure everyone knows how much the village wants this matter cleared up.  It is in the best interest of everyone to handle this in a professional manner. The village has made every adjustment possible to please township including honoring the vote of 8-17-11, which cost the village residents extra taxes.  He explains the village council position siting 10 items as follows:

  1. Both township and village had agreed on all points of fire agreement.
  2. Township wanted agreement to start Oct. 1, 2011 (village agrees)
  3. Township asked to prorate agreement (village agrees)
  4. Township prorates  agreement except #8, additional township contributions, having this start on 4/1/12
  5. Village authorized Baker to get the question of #8 resolved and village would sign agreement and we could all move on.
  6. Baker and Miller meet, and call fire board auditor, who agreed the fire board paid $6877.20 for this fiscal year 2011-2012 to water dept.
  7. Township Treasurer was to talk to Township Supervisor about this meeting and the disputed amount paid to water dept.
  8. Village hears nothing from Township about this issue
  9. Township attorney tells Village attorney, township will not prorate #8 of the agreement
  10. Village sees nothing in township minutes, no vote or motion or discussion on  #8 of the agreement.

Village council votes (Dec. 12 council meeting) to table all fire agreement items until this matter is cleared up.

Township and Village residents, felt that the township should do as they said and honor the contract as it was written.  The proration was set in contract for Oct. 1, 2011, council and fire dept. auditor both agreed that the disputed $1300.00 is owed by township.  Ed Bell, from the council was part of the team that put this contract in place.  He wanted to know if Township could show village council where any errors were made.  Township replied that nothing was incorrect in contract.  Bell than stated “ township must do what is right, we must put this past us and move on for the betterment of the community.”

Mike Zimmerman from township board agrees with village and their position.  Zimmerman moves to rescind approval of purposed contract Township/Village.   Suggest, township bring sinking fund contribution to prorated date of Oct. 1, 2011 and pay $1300.00. This was seconded by Township board member Smigla, who also feels that this needs to be settled and township should do their part to rectify the situation.  Roll call vote with 2 yeas, Zimmerman and Smigla and 3 Nays-Jackson, McKelvy, Miller motion fails.

As of today’s date, Dec. 27, 2011 we do not have a fire agreement in place.
